Zakona o doprinosima (\u201eNarodne novine\u201c, br. 84\/08., 152\/08., 94\/09., 18\/11., 22\/12., 144\/12., 148\/13., 41\/14., 143\/14., 115\/16., 106\/18. i 33\/23. \u2013 dalje u tekstu: Zakon) poslodavac je oslobo\u0111en pla\u0107anja doprinosa na osnovicu odnosno doprinosa za zdravstveno osiguranje za osiguranika koji se prvi put zapo\u0161ljava u razdoblju do godine dana.<\/span><\/p>\n<p><span style=\"font-family: helvetica, arial, sans-serif; font-size: 12pt;\">\u010clankom 7. to\u010dkom 31. Zakona propisano je da osoba koja se prvi put zapo\u0161ljava jest fizi\u010dka osoba koju poslodavac, po osnovi ugovora o radu, odnosno ugovora o stru\u010dnom osposobljavanju za rad prijavljuje na obvezno mirovinsko osiguranje i obvezno zdravstveno osiguranje te do dana po\u010detka osiguranja nema evidentiran sta\u017e u mirovinskom osiguranju, odnosno ima evidentiran sta\u017e do osam dana (uklju\u010duju\u0107i i osmi dan) po osnovi drugog dohotka, osim po osnovi roditelja koji obavlja roditeljske du\u017enosti, niti je sta\u017e mirovinskog osiguranja ostvario kod inozemnog nositelja obveznoga mirovinskog osiguranja, osim fizi\u010dke osobe iz to\u010dke 54. istoga \u010dlanka.<\/span><\/p>\n<p><span style=\"font-family: helvetica, arial, sans-serif; font-size: 12pt;\">Sukladno \u010dlanku 16.a stavku 4. Pravilnika o doprinosima (\u201eNarodne novine\u201c, br. 2\/09., 9\/09. &#8211; ispravak, 97\/09., 25\/11., 61\/12., 86\/13., 157\/14., 128\/17., 1\/19. i 43\/23.) za osobu koja se prvi put zapo\u0161ljava \u2013 stranca poslodavac je du\u017ean o tome osigurati dokaz. Dokaz je pisana isprava nositelja obveznog mirovinskog osiguranja dr\u017eave stranca izdan u skladu s me\u0111udr\u017eavnim ugovorom o socijalnom osiguranju iz kojega je vidljivo da je rije\u010d o osobi koja do po\u010detka osiguranja po prijavi tog poslodavca, nema evidentiran sta\u017e u obveznom mirovinskom osiguranju.<\/span><\/p>\n<p><span style=\"font-family: helvetica, arial, sans-serif; font-size: 12pt;\">Nadalje, prema \u010dlanku 20. stavcima 4. i 5 . Zakona poslodavac je oslobo\u0111en pla\u0107anja doprinosa na osnovicu odnosno doprinosa za zdravstveno osiguranje za osiguranika mladu osobu u razdoblju do pet godina.<\/span><\/p>\n<p><span style=\"font-family: helvetica, arial, sans-serif; font-size: 12pt;\">\u010clankom 7. to\u010dkom 54. Zakona propisano je da mlada osoba jest fizi\u010dka osoba koju poslodavac po osnovi ugovora o radu sklopljenog na neodre\u0111eno vrijeme prijavljuje na obvezno mirovinsko osiguranje i obvezno zdravstveno osiguranje te do dana po\u010detka osiguranja ima manje od 30 godina \u017eivota, a do dana sklapanja ugovora o radu nije imala prethodno sklopljen ugovor o radu na neodre\u0111eno vrijeme s istim poslodavcem.<\/span><\/p>\n<p><span style=\"font-family: helvetica, arial, sans-serif; font-size: 12pt;\"><strong><span style=\"color: #ff0000;\">S obzirom na navedeno, poslodavac mo\u017ee koristiti oslobo\u0111enje od obveze doprinosa za stranca \u2013 dr\u017eavljana tre\u0107e zemlje osiguranog po osnovi radnog odnosa \u2013 mladu osobu ako su zadovoljeni prethodno navedeni uvjeti (osoba mla\u0111a od 30 godina, ugovor o radu sklopljen na neodre\u0111eno vrijeme i prethodno s istim poslodavcem nema sklopljen ugovor o radu na neodre\u0111eno vrijeme) bez obzira iz koje dr\u017eave stranac dolazi jer dokaze o zadovoljenju uvjeta posjeduju radnik i poslodavac.<\/span><\/strong><\/span><\/p>\n<p><span style=\"font-family: helvetica, arial, sans-serif; font-size: 12pt;\">Poslodavac tako\u0111er mo\u017ee koristiti oslobo\u0111enje od obveze doprinosa za stranca \u2013 dr\u017eavljana tre\u0107e zemlje osiguranog po osnovi radnog odnosa \u2013 osobu koja se prvi put zapo\u0161ljava ako je zadovoljen prethodno navedeni uvjet (osoba nema evidentiran sta\u017e u mirovinskom osiguranju), me\u0111utim, samo za stranca koji dolazi iz dr\u017eave s kojom Republika Hrvatska ima sklopljen ugovor o socijalnom osiguranju jer se dokaz o zadovoljenju uvjeta mora pribaviti od nositelja obveznog mirovinskog osiguranja dr\u017eave iz koje stranac dolazi.\u200b<\/span><\/p>\n<\/div>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n","protected":false},"excerpt":{"rendered":"<p>U praksi postoji neodumica mo\u017ee li poslodavac, radnika iz &#8220;tre\u0107e&#8221; zemlje, zaposliti na neodre\u0111eno vrijeme i ako je radnik mla\u0111i od 30 godina mo\u017ee li ga zaposliti u statusu &#8220;mladi radnik&#8221;\u00a0 (Radni odnos osobe mla\u0111e od 30 godina prema Zakonu o doprinosima) i temeljem toga 5 godina koristiti olak\u0161icu oslobo\u0111enje od pla\u0107anja doprinosa na pla\u0107u.
